Over the past twenty years, the world has seen a monumental shift in how the family is perceived. The most recent statistical data on marriages released by the Office for National Statistics found that the number of people aged over 65-years choosing to marry or remarry increased by 46% between 2004 and 2014.

Although it is excellent that so many older people should find happiness in later life, it poses many potential inheritance headaches that Willwriters and Estate Planners need to be able to remedy.

92% of this age group choosing to remarry were divorcees, widows or widowers. Therefore, it is very likely that at least one member of a couple approaching a marriage in later life will already have children they may want to provide for in the event of their death.

As a new marriage will render an existing Will void, it is important that all clients are aware of this when they enter their new union.

There has in recent years been a significant increase in the popularity of Trusts which can offer a more long-term solution in ensuring that a client’s loved ones are provided for, even as the testator’s circumstances evolve and change.
